1. Introduction
These Terms of Service govern your use of the WordPress maintenance, support, and bug-fixing services provided by Rakesh Raja ("WPGuru", "I", "me", "my"). By engaging my services, you agree to these terms. If you do not agree, please do not use my services.
2. Services
I provide the following types of services:
- Ongoing Maintenance — regular WordPress core, plugin, and theme updates, security monitoring, and backups as described in the selected plan
- One-Off Fixes — specific bug fixes, troubleshooting, or site repairs performed on a per-task basis
- Custom Work — development of new features, custom functionality, or design changes as agreed upon
Each service is performed according to the scope agreed upon before work begins. Any work outside the agreed scope may incur additional charges.
3. Payment Terms
- Maintenance plans are billed monthly in advance. Payments are due within 7 days of the invoice date.
- One-off fixes are billed upon completion unless otherwise agreed.
- Payments are processed through secure third-party payment processors.
- Plans can be cancelled at any time with 7 days' notice. No partial refunds for the current billing period.
4. Client Responsibilities
To enable me to provide services effectively, you agree to:
- Provide necessary access to your website (WordPress admin credentials, hosting access, etc.)
- Maintain current backups of your website before any work begins
- Communicate issues clearly and respond to inquiries in a timely manner
- Ensure you have the legal right to modify your website and authorize me to do so
5. Limitation of Liability
I provide my services with reasonable care and skill. However:
- I am not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use my services
- I am not responsible for data loss — you must maintain your own backups
- I do not guarantee that your website will be completely free from vulnerabilities or security breaches
- My total liability is limited to the amount you paid for the specific service giving rise to the claim
6. No Guarantee of Specific Results
I cannot and do not guarantee specific outcomes such as improved search engine rankings, increased traffic, or higher revenue as a result of my services. I provide technical WordPress services — the results depend on many factors outside my control.
7. Intellectual Property
All work I create for you (code, configurations, documentation) is your property upon full payment. I retain the right to display completed work in my portfolio unless otherwise agreed.
8. Cancellation & Termination
- You may cancel your maintenance plan with 7 days' notice
- I reserve the right to terminate services if payments are more than 30 days overdue
- I may refuse service to anyone at my discretion
- Upon termination, I will provide you with all work completed up to that point
9. Changes to Terms
I may update these terms from time to time. Clients will be notified of material changes via email. Continued use of my services after changes constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by the laws of India. Any disputes shall be resolved in the courts of Gujarat, India.
